These laws state that licensed drivers have given police implied consent to conduct field sobriety tests should you be stopped on suspicion of DUI. Refusing to submit to such tests carries severe penalties in Maryland, such as the suspension of your driving license for up to a year.

The Legal Blood Alcohol Concentration (BAC) Limit

In Maryland, if you have a BAC level above .08 percent you’re considered legally intoxicated, and even if it is lower, you may face Maryland DUI penalties. However, confirmation that your BAC is above .08 percent is all that is needed to arrest you on DUI charges in Maryland.

Maryland has zero tolerance laws for underage drinking and driving. If you are under 21 and operating a vehicle while you have a .02 percent BAC or higher, you are subject to penalties.

Penalties for a Maryland DUI involve suspension or revocation of your license. For first offenders, this suspension is for a minimum of 90 days. Second time offenders face a one-year license suspension, and third time offenders face a three-year license suspension.

An alcohol education program, alcohol abuse treatment, and an alcohol or drug dependence review may also be mandated for DUI offenders. These penalties are often suggested in lieu of jail time or fines.
